Access to Genetic Resources and the Fair and Equitable Sharing of Benefits arising from their Utilization

Since 12 October 2015, by virtue of Regulation (EU) no 511/2014 of the European Parliament and of the Council of 16 April 2014, EU member states which are parties to the Nagoya Protocol may opt to manage the access to their genetic resources, and are required to ensure that the benefits arising from the utilization of such resources through research and development are shared fairly and equitably with the providers of such genetic resources. The same obligations apply to the access and utilization of traditional knowledge associated with these genetic resources.

Malta acceded the Nagoya Protocol on 1 December 2016 and became Party to the Protocol on 1 March 2017. Users of genetic resources and associated traditional knowledge governed by Malta are obliged to abide by the requirements of Legal Notice 379 of 2016 of Malta’s national law.

Under this legal instrument, the Director responsible for Plant Health Services is established as the national ABS Competent Authority responsible for the implementation of the Legal Notice, EU Regulation and the Nagoya Protocol dealing with ABS.

In order to assist potential users of Malta’s genetic resources and associated traditional knowledge, the Competent Authority has made available a brief guide intended to walk interested individuals and entities through the process of obtaining Prior Informed Consent to access genetic resources and associated traditional knowledge, and negotiating Mutually Agreed Terms for their utilization.
